1.3.7 Manufacturer
Is any natural or legal person who designs and/or manufacture lifting equipment or partly completed lifting equipment and is responsible for the conformity of the equipment with the applicable legal requirements with a view to its being placed on the market, under his own name or trademark or for his own use. In the absence of manufacturer as defined above, any natural or legal person who places the equipment on the market or puts it into service shall be considered a manufacturer.
Manufacturers placing lifting equipment onto the EU market from outside of the EU, must have an authorised representative within the EU. The authorised representative is any natural or legal person established in the EU who has a written mandate from the manufacturer to perform on his behalf all or part of the obligations and formalities connected with directive 2006/42/EC. As a minimum this means compiling the technical file.
The manufacturer or authorised representative are also commonly referred to under the collective term ‘Responsible Person’
